In a significant development related to an insurance claim dispute, the Delhi State Consumer Disputes Redressal Commission has dismissed the New India Insurance Co. Ltd. (New India Insurance) ‘s appeal. This decision upholds an earlier order awarding substantial compensation to Sheela Foam Limited (Sheela Foam).
On April 04, 2024, the District Consumer Disputes Redressal Commission- IX (East District) ruled in favour of Sheela Foam, awarding them compensation of ₹21,38,77,055 (approximately $26.7 million USD) in an insurance claim dispute with New India Insurance. The District Commission also directed New India Insurance to pay interest at a rate of 10% per annum from the date of claim rejection, along with additional compensation of ₹7,50,000 for mental stress and losses and ₹2,50,000/- for legal expenses incurred by Sheela Foam.
New India Insurance attempted to challenge this ruling by filing an appeal before the Delhi State Consumer Disputes Redressal Commission on June 21, 2024. However, their appeal was dismissed on the grounds of delayed filing. The Commission determined that New India Insurance failed to provide adequate justification for the delay in filing their appeal beyond the stipulated time frame.
The order upholding the District Commission’s decision was received by Sheela Foam on July 02, 2024. This development strengthens Sheela Foam’s position in recovering the disputed insurance claim amount and associated compensation. The substantial award underscores the potential consequences for insurance companies that are found to have wrongfully denied or delayed valid claims.
While the current ruling favours Sheela Foam, New India Insurance may still have the option to pursue further legal recourse. It remains to be seen whether they will choose to take this path or accept the final decision of the Delhi State Consumer Disputes Redressal Commission.
